Before you appeal — understand the denial
Do this first
Received the denial in writing — not just a verbal notification
If you only received a verbal denial by phone, call your insurer and request the formal denial letter and your Explanation of Benefits (EOB) in writing. You need the written denial to appeal.
Identified the specific denial reason and denial code from the letter
The denial letter must state the reason by law. Find the specific reason — medical necessity, prior auth, out-of-network, etc. — and the associated denial code. Use the Denial Decoder below if the reason is unclear.
Confirmed your exact appeal deadline and added it to your calendar
Use the deadline calculator at the Insurance Denial Appeal Builder page. Write the date on paper and set a calendar reminder for 7 days before the deadline. Missing the deadline permanently ends your right to appeal.
Requested the specific clinical criteria used to deny the claim
Call your insurer and ask: "What specific clinical criteria and policy provisions were used to deny this claim?" You are legally entitled to these. Once you have them, your doctor can address each point directly in their letter.

Documents to gather — before writing your appeal
Gather before writing
Letter of Medical Necessity obtained from treating physician
Ask your doctor to write a detailed letter explaining why this treatment is medically necessary specifically for your condition — not a generic template. The letter should directly address the insurer's stated denial reason and reference the clinical criteria cited.
Copy of original denial letter saved and ready to include
Always include a copy of the denial letter with your appeal so the reviewer can immediately reference the original decision without searching for it.
Relevant medical records copied — only sections supporting the appeal
Include prior diagnoses, treatment history, test results, and physician notes directly relevant to the denied treatment. Do not send your entire medical history — only what directly supports this appeal.
Explanation of Benefits (EOB) from insurer obtained and reviewed
Get your EOB from your insurer's online portal or by calling member services. Review it to understand how the claim was processed, what was denied, and on what grounds.
Clinical guidelines or peer-reviewed research gathered (if denial is experimental / not necessary)
For denials based on "experimental" or "not medically necessary" grounds, ask your doctor for published clinical guidelines from medical societies or peer-reviewed research that supports the treatment as standard of care.

Sending by certified mail — tracking number saved
Always send formal appeals by certified mail. The tracking number is your proof of the date filed and confirmation of delivery. This is critical if the insurer later claims they did not receive your appeal on time.
Complete copy of everything submitted kept for personal records
Before sealing the envelope, make photocopies of every single page in your submission. Keep originals — never send originals. Store everything in a dedicated folder for this appeal.
Requested written confirmation of receipt and a case reference number
After sending, call the insurer's appeals department and ask them to confirm receipt and provide a case number. Note the date, time, and representative name for your log.

Insurers are typically required to respond within 30 days for standard appeals and 72 hours for urgent appeals. If you do not hear back by the deadline, call and follow up in writing.

If the internal appeal fails — escalation paths

Under the ACA, you have the right to an Independent External Review if your internal appeal is denied. An independent organization — not your insurer — makes a binding decision. External reviews overturn insurer decisions approximately 40% of the time.
Considered filing a complaint with state Insurance Commissioner
Your state's Insurance Commissioner regulates insurer conduct. Filing a complaint can apply regulatory pressure and sometimes results in the denial being reversed without further legal action.
Contacted employer HR department if using employer-sponsored insurance
If your insurance is through your employer, your HR department has leverage with the insurance company that individual members do not. Escalating through HR can sometimes resolve denials faster than the formal appeals process.
